Terms of Service
Effective 16 October 2026
These terms are an agreement between you and Peter Burkhardt, doing business as FOMO4NFT, a sole proprietorship at 515 East Fir Avenue, Lompoc, California 93436, United States ("FOMO4NFT", "we", "us"), about the app at https://fomo4nft.com and everything it does. By signing in or using the app you accept them. If you do not accept them, do not use the app.
1. What the app is
FOMO4NFT is software for buying, minting and selling NFTs on Robinhood Chain. Orders are placed on OpenSea's marketplace and drop contracts; prices, listings and schedules come from OpenSea and the chain. The app also offers a feed, a leaderboard, giveaways, and Copycat, which repeats the trades of wallets you choose, under rules you set.
We are not an exchange, broker, bank, investment adviser or money transmitter, and nothing in the app is financial, legal or tax advice. Every trade is your decision.
2. Who may use it
- You must be at least 18 years old and able to enter a binding contract.
- You must not be in, or a resident of, a country or region subject to comprehensive sanctions, and you must not be on any sanctions list.
- You must use the app only where it is lawful to do so, and you are responsible for the laws that apply to you, including tax.
- Buying ETH with Apple Pay is offered by Coinbase to people in the United States only, under Coinbase’s own terms.
3. Your account
You sign in with your X account. You are responsible for keeping that account secure and for everything done from yours. One account per person. We may close an account that breaks these terms.
4. Your trading wallet
Your account trades from a wallet on Robinhood Chain. There are two kinds.
- A Coinbase wallet: every wallet made since October 2026. It is yours. Coinbase holds its key for you in a secure enclave, you sign in to it with an email code, and you can export the key at any time. We never have the key. The app sends transactions from it only under a permission you grant from your own browser, for up to 30 days at a time, which you can end at any moment.
- An app-held wallet: accounts from before then, until they move. It is an ordinary wallet whose key is encrypted and held on our servers so that the app can send transactions from it. Its recovery phrase is shown to you once, when you ask for it, and then deleted from our servers; with it you can use the wallet in any wallet app without us.
- With either kind the app signs only these transactions: buys and mints through OpenSea; sales through OpenSea; the Copycat trades you have configured; withdrawals of ETH and NFTs to wallets you have proven you control; and transfers between chains that you request.
- You can withdraw everything in your trading wallet at any time, to a wallet you have proven. We never block a withdrawal except where the law requires it.
- Your trading wallet is yours. We do not pool, lend, stake or otherwise use what is in it. It is not a bank account, it is not insured, and we are not a custodian in the sense of any banking or securities law.
- If our servers are compromised, what an app-held wallet holds may be at risk, and a Coinbase wallet could be traded from within the permission you granted until you end it. Keep in your trading wallet only what you mean to trade.
5. Funding
- You fund your trading wallet by sending ETH to it from a wallet of your own, on Robinhood Chain, or from Base, Arbitrum or Ethereum through a bridge (Relay) that your own wallet signs after the app quotes it.
- ETH sent to your trading wallet’s address on Base, Arbitrum or Ethereum stays there until you press Move; the app then bridges it for you through Relay. Bridges are performed by Relay under its own terms and can fail, refund or take time. The app does not hold funds in transit.
- Apple Pay is provided by Coinbase. Coinbase collects your contact, identity and payment details, charges you, and delivers ETH on Base to a wallet you control that you have proven to the app. Your use of it is governed by Coinbase’s Guest Checkout Terms of Service, User Agreement and Privacy Policy. We receive only the order’s amount, status and a token that lets Coinbase recognise you next time.
- Only ETH is supported. Other tokens sent to a trading wallet may be lost.
- Network fees (gas), OpenSea fees, Relay fees and Coinbase fees are set by those parties and are paid by you.
6. Trading, minting and Copycat
- When you buy, mint or sell, the app builds the transaction with OpenSea and sends it from your trading wallet. Once sent, a transaction cannot be reversed.
- Copycat repeats the buys of wallets you pick, with limits you set, while you are away. It can buy things you would not have bought. Its trades are yours.
- Prices and availability change between the moment you see them and the moment a transaction confirms. A trade can fail, cost more than shown, or go through at a different price.
- You are responsible for what you buy, including its legality and its rights.
7. Subscriptions
Copycat, Pro and Super are subscriptions of 30 days, paid by burning a set dollar value of $CANNACAT, a token on Robinhood Chain, from a wallet of yours. The burn is final and not refundable, and the days are added to whatever is left. We do not sell $CANNACAT and do not control its price; nothing regulated is sold through the app.
8. Giveaways
Anyone signed in can run a giveaway: a game, a prize, a window, and a link. Entry is free. No purchase, payment or deposit is needed to play, and the board is decided by skill in the game. The prize is provided and sent by the person running the giveaway; we are not a party to it. Whoever runs a giveaway must make sure it is lawful where they and their players are.
9. What is public
Your trades, positions, profit and loss, posts and leaderboard standing are public and shown with your X name. Anything you post can be seen by anyone with access to the app.
10. Acceptable use
- No unlawful use, fraud, money laundering, or dealing in stolen or sanctioned assets.
- No wash trading, manipulation, or interfering with other people’s trades or giveaways.
- No attempts to access another account, another wallet, or our servers beyond what the app offers.
- No automated scraping or abuse of the app or the services it relies on.
11. Risks
NFTs and ETH are volatile and can lose all their value. Smart contracts, chains, bridges and marketplaces can fail or be exploited. Robinhood Chain, OpenSea, Coinbase and Relay are run by others and can change or stop without notice. You accept these risks when you use the app.
12. Our services, as they are
The app is provided as it is and as available, without warranties of any kind. To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, or loss of profits, data or assets, arising from your use of the app, a third-party service, or a transaction on the chain. Where liability cannot be excluded, it is limited to the greater of what you paid us in the last twelve months and one hundred US dollars. You agree to indemnify us against claims arising from your use of the app in breach of these terms or the law.
13. Ending things
You may stop using the app at any time and withdraw what you hold. We may suspend or close an account that breaks these terms or the law, or where a service we rely on requires it. In either case you keep the right to withdraw what is in your trading wallet, unless the law forbids it.
14. Governing law
These terms are governed by the laws of the State of California and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute that cannot be settled between us goes to the state and federal courts in Santa Barbara County, California, and you agree to their jurisdiction.
15. Changes
We may change these terms. The date at the top says when they last changed, and material changes will be announced in the app. Using the app after a change means you accept it.
16. Contact
Questions about these terms go to Peter Burkhardt, doing business as FOMO4NFT, 515 East Fir Avenue, Lompoc, California 93436, United States, or through the FOMO4NFT account on X. See also the Privacy Policy.
